AGREEMENT TO OUR REWARDS PROGRAM TERMS

These Splash Points Rewards Program Terms and Conditions constitute a legally binding agreement made between you, whether personally or on behalf of an entity ("you"), and Fresh Pool Supply, LLC. ("Company," "we," "us," "our"), concerning your access to and participation in the Splash Points rewards program (the "Program").

By participating in the Program, you agree that you have read, understood, and agreed to be bound by all of these terms.

1. ELIGIBILITY AND ENROLLMENT

The Program is offered by Fresh Pool Supply, LLC. and is open to individuals who are at least 18 years of age and reside in the United States. The Program is available to residential and trade accounts. Commercial, wholesale, and distributor accounts are expressly prohibited from participating. You must create and log into a registered customer account on https://www.freshpoolsupply.com (the "Site") to enroll and participate in the Program. Only one account is permitted per person.

2. EARNING SPLASH POINTS

Members earn one (1) Splash Point for every $1.00 USD spent on qualifying purchases made through the Site. To accrue points, you must be logged into your registered account prior to completing checkout. Points are calculated based on the merchandise subtotal after any discounts have been applied. Splash Points are not earned on taxes, shipping fees, gift card purchases, or prior transactions.

3. REDEEMING SPLASH POINTS

Accumulated Splash Points may be redeemed at checkout. Fifty (50) Splash Points may be redeemed for a $1.00 USD reward credit. Splash Points rewards cannot be combined with other promotional codes or coupon offers in a single transaction. Reward credits apply solely to the merchandise subtotal and cannot be used to pay for shipping fees, taxes, or the purchase of gift cards. Splash Points have no cash value, are non-transferable, and cannot be redeemed for cash or cash equivalents.

4. POINT EXPIRATION

All Splash Points expire exactly 365 days from the date they were accrued.

5. REFER A FRIEND

Members are eligible to earn a promotional bonus of two hundred (200) Splash Points for each successful referral of a new customer. A successful referral requires the referred new customer to complete a non-refundable purchase of at least $50.00 USD on the Site. Self-referrals, creating multiple accounts, or referring customers residing within the same household are strictly prohibited and will result in the immediate forfeiture of points and potential account suspension.

6. RETURNS AND REFUNDS

In the event of a returned item, canceled order, or refunded transaction, the Splash Points originally earned from that specific merchandise will be automatically deducted from your account balance. If a return deduction causes your point balance to fall below zero, your account will reflect a negative points balance until future qualifying purchases offset the deficit. If you used reward points to purchase an item that is later returned, the points redeemed for that purchase will be credited back to your account.

7. ACCOUNT MANAGEMENT

You may view your real-time Splash Points balance, accrual history, and upcoming expirations at any time by logging into your registered account and navigating to the "Your Account" dashboard on the Site.

8. PROGRAM MODIFICATION, TERMINATION, AND ABUSE

We reserve the right, at our sole discretion, to cancel, modify, or restrict the Program at any time and without prior notice. This includes, without limitation, changes to earn rates, redemption values, eligibility criteria, and expiration rules. In the event of Program termination, all unredeemed Splash Points will be immediately forfeited without compensation. Furthermore, we reserve the right to revoke points, suspend, or terminate the accounts of any members suspected of fraud, abuse, gaming the system, or violation of these Terms.

9. TAX LIABILITY

Members are solely responsible for any state, federal, or local tax liability related to their participation in the Program and the receipt or use of rewards.

10. OPTING OUT AND ACCOUNT CLOSURE

Members may opt out of the Program at any time by contacting our customer support team. Opting out results in the immediate and permanent forfeiture of all accumulated Splash Points. Closing your Fresh Pool Supply customer account will also result in the immediate cancellation of your Program membership and the loss of all unredeemed points.

11. RELATION TO GENERAL LEGAL TERMS

These Program terms are subject to, and shall be read in conjunction with, our general Legal Terms available on the Site, including but not limited to the provisions regarding Dispute Resolution, Limitations of Liability, and Indemnification. In the event of a conflict between these Program terms and the general Legal Terms, these Program terms shall govern strictly with respect to the Program.
